Terms of Service

These Terms of Service (“Terms”) govern your use of Hostly (“we”, “our”, or “us”), a platform that connects content creators (“Creators”) with hotels, restaurants, and venues (“Hosts”).

By using Hostly, you agree to these Terms.

1. Platform Overview

Hostly is a marketplace platform that facilitates collaborations between Creators and Hosts.

  • Hosts offer experiences (e.g. stays, meals, access)
  • Creators apply and provide content in exchange
  • Hostly provides tools to manage agreements, communication, and delivery

Hostly is not a party to the agreement between Creator and Host.

2. User Roles

Creators: Creators apply to opportunities and agree to deliver content.

Hosts: Hosts create offers and select Creators.

Users may act as both.

3. Collaboration Agreement

When a Host accepts a Creator:

A binding agreement is formed including:

  • Deliverables (e.g. number of posts, format)
  • Deadlines
  • Experience provided (e.g. free stay, meal, access)

Both parties are responsible for fulfilling their obligations.

4. Escrow & Credit System (Important)

Hostly may use an in-app credit system (via Apple In-App Purchases) to facilitate commitments.

How it works:

  • Hosts may allocate credits to secure a collaboration
  • Credits are held by Hostly until completion
  • Credits may be released, refunded, or retained based on outcomes

Important:

  • Credits are non-cash, non-transferable, and have no real-world monetary value outside the app
  • Apple handles all payments and refunds according to its policies

Hostly reserves the right to resolve disputes involving credits at its sole discretion.

5. Completion & Verification

A collaboration is considered complete when:

  • The Creator submits required content
  • The Host confirms completion OR
  • Hostly verifies delivery through platform data

Hostly may use: Content links, upload verification, and manual review.

6. Cancellations & No-Shows

Creator No-Show: If a Creator fails to attend or deliver, credits may be forfeited and account penalties may apply.

Host Cancellation: If a Host cancels without valid reason, credits may be refunded and account penalties may apply.

Hostly determines validity at its discretion.

7. Disputes

If a dispute arises, both parties may submit evidence. Hostly reviews content, communication, and activity.

Hostly may decide to release credits, refund credits, split credits, or penalize accounts. All decisions are final and binding.

8. Content Rights

Creators retain ownership of their content.

However, by participating:

  • Creators grant Hosts a license to use content for marketing (unless otherwise agreed)
  • Creators grant Hostly a license to display content within the platform

Users must own or have rights to all uploaded content and not infringe third-party rights.

9. Prohibited Behavior

Users may not:

  • Provide false metrics or fake followers
  • Fail to deliver agreed content
  • Attempt to bypass the platform (e.g. taking deals off-platform)
  • Upload illegal or infringing content
  • Harass or abuse other users

Violation may result in suspension or termination.

10. Ratings & Reputation

Hostly includes a rating system. Reviews must be honest and accurate. We may remove fraudulent or abusive reviews. Reputation affects access to future opportunities.

11. Account Suspension & Termination

We may suspend or terminate accounts for violations of these Terms, fraud or abuse, or repeated cancellations or poor performance. We may do so without prior notice.

12. Limitation of Liability

Hostly is a platform only. We are not responsible for: quality of experiences, creator performance, missed expectations, or any damages arising from collaborations.

Use the platform at your own risk.

13. Indemnification

You agree to indemnify Hostly from any claims arising from your content, your collaborations, or your violation of these Terms.

14. Payments & Apple Compliance

All payments are processed via Apple In-App Purchases. Hostly does not process external payments. Refunds are subject to Apple’s policies.

15. Changes to Terms

We may update these Terms at any time. Continued use of the app constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of United Kingdom.
